AND MOTION TO PRODUCE BY ETOWAH COUNTY DEFENDANTS 

l. In 1968, Booker T. Borden, a black gentleman, ran for 

associate member of the Etowah County Commission from District 

No. 3. He was not elected. 

In the 1968 General Election Walker S. Alexander, a black 

gentleman, ran for Board of Education, Place No. 1. He was not 

elected. 

In 1976, Leon Ballou, a black gentleman, ran for associate 

commissioner of the Etowah County Commission for District No. 

2. He was not elected.

3. Mr. Gene E. Robinson was appointed to the Board of 

Equalization in Etowah County by the Governor of the State of 

Alabama for a four year term. 

Mr. Nathaniel Stanley was one of the appointees on the 

Etowah County Personnel Board for a four year term. 

Each of the gentlemen were black, and male. The date of 

selection of each is unknown, but both are presently serving.

4. Solid Waste Authority. A Legislative Act prescribes a 

three member board for the Authority composed of the Chairman of 

the Etowah County Commission, the Etowah County Health Officer, 

and a third member appointed by the two. 

The various rural incorporated water authorities in Etowah 

County submit the names of directors of the water board who have 

been chosen by the water authorities, and ask the approval of 

the same by the Etowah County Commission. 

Advisory Board members of the Department of Pensions & 

Security are from time to time appointed by the Etowah County 

Commission. The names of the persons to be placed on the board 

are suggested by the director of the Department of Pensions & 

Security and the commission approves those names submitted by 

the director of the Department of Pensions & Security. 

The Etowah County Commission appoints one member to the 

Etowah County Personnel Board who serves a term of three years. 

This is a new board, begun one year ago. The initial appointees 

to the board were, Nathanial Stanley, male, black; John Thomas, 

male, white; Bill Bailey, male, white; Robert Means, male, 

white; and Tom Wiggonton, male, white. The other four members 

are appointed as follows: One member by the Probate Judge and 

Sheriff; one member by the Tax Assessor and Tax Collector; one 

member by the Etowah County Labor Council; and one member by the 

Etowah County Chamber of Commerce. All members were appointed 

approximately one year ago.

5. Mattie L. Woody v. Etowah County Probate Judge, United 

States District Court for the Northern District of Alabama, 

Civil Action # CV-84-AR-1100-M, filed December 10, 1984. The 

action alleged that the Probate Judge discriminated against Mrs. 

Woody in the terms and conditions of her employ- 

ment because of her race by paying higher wages to white clerks 

having the same duties and less experience in work. Later the 

suit was amended to name the Etowah County Commission. The 

action was defended by the attorneys for the insurance carriers 

for the county. It is believed that this case was dismissed 

with prejudice. 

Emily Howell v. Etowah County Commission, United States 

District Court for the Northern District of Alabama, Civil 

Action # CV-83-AR-2497-M. The plaintiff sought reinstatement 

with back pay for alleged discriminatory conduct on account of 

her race; that she was denied a position of key-punch operator 

on account of her race and was subsequently discharged because 

of having assertive rights under the Federal Anti-Discrimination 

Laws. The action was dismissed on May 15, 1984. 

Emily Howell Davis v. Etowah County Commission, United 

States District Court for the Northern District of Alabama, 

Civil Action #CV-85-AR-0217-M. Plaintiff alleged that her 

duties qualified her for other, higher paying positions with the 

 



county other than a data entry clerk for which she was employed; 

that vacancies occurred in other positions but instead of 

filling those positions with Mrs. Davis, she was passed over for 

other employees because of her race and color. The case was 

dismissed. 

6. Yes. Ms. Guy E. Harris vs. Etowah County Sheriff's 

Department, EEOC Complaint No. 04281-1151. Ms. Harris stated 

she believed she was being discriminated against because of her 

race and her sex in not being permitted to select shift 

assignments during her work as a matron in the Etowah County 

Jail. It is believed that EEOC found no reasonable cause to 

believe that the allegations were true. 

Mrs. Mattie L. Woody v. Etowah County Probate Judge's 

Office, EEOC No. 04283-1803. Mrs. Woody claimed discrimination 

against her in respect to wages because of her race. EEOC found 

no reasonable cause to believe that the allegations made in the 

charge were true. 

Ms. Judy Harris v. Etowah County CETA Prime Sponsor. EEOC 

No. 042831220. Ms. Harris complained of sexual advancements by 

the director of CETA, Mr. Harold T. Mayo, and alleged that she 

was treated that way by the Director of the Etowah County Prime 

Sponsor and the Etowah County Commission because she was a black 

female. It is believed that the EEOC found no basis for the 

charge. But no final disposition is noted. 

Emily Howell v. Etowah County Commission, EEOC No. 

042830200. Mrs. Howell alleged discrimination based upon her 

race in that she was denied a position of key-punch operator and  



  

was subsequently discharged by the Etowah County Commission 

because of her having asserted rights under the Federal 

Anti-discrimination laws. EEOC found no reasonable cause to 

believe that the allegations made the basis of the action were 

true.

accommondations or housing. 

8. Find enclosed herewith the Affirmative Action Plan of 

Etowah County, Alabama, passed and adopted on February 6, 1979, 

and in force and effect since that date. The original of the 

affirmative action plan is located in the offices of the Etowah 

County Commission.

10. The Etowah County Commission has no housing developments 

controlled by the Commission or any of its agencies. 

11. As far as is known no federal voting registrars have 

ever been sent to Etowah County to register black votes, or to 

monitor elections or for any other purpose.

Lee Wofford when he ran for county commission. Mr. Wofford is 

presently Probate Judge by appointment from the Governor. The 

others are not available. 

(d) Campaign monies by each candidate were used for 

radio advertisements on WGAD and WAAX, handbills, bumper 

stickers, newspaper advertisements, and campaign posters. 

(e) Campaign literature is not now available. 

(f) All candidates at the last election attended 

Goodsel Methodist Church, the Etowah County Voters League, and 

Gadsden State Technical College where campaign appeals were made 

for votes. All candidates were interviewed by the Etowah County 

Voters League and Gadsden State Technical Institute. 

(g) None, except the candidates went the Kiwanis 

Pavilion where a jamboree was sponsored by the Democratic party 

and Local 2176 of the United Steelworkers. A campaign speech 

was made by all candidates. 

(h) All promised honest good government. 

(i) As far as is known all candidates for each office 

spoke. 

 



(J) All candidates asked for the black vote and 

attended meetings asking for that vote. The black vote in 

Etowah County many times is the deciding vote. 

(k) There were no paid members of campaign staffs. 

(1) There is no way of determining the number of blacks 

and whites who worked in the campaign of each candidate.

14. Robert V. Hitt, Chairman, Etowah County Commission. 

The records are in the custody of Etowah County Commission.

make law or to determine how it is to be elected. This is done 

by the Alabama State Legislature.

past elections were characterized by racial voting.

Findings of Fact and Remedies 

Etowah County Employment Practices 

a)” Findings of Fact 
  

Documents obtained during the investigation disclosed that 
the County has a full-time labor force of 146 persons. Blacks 
and women are significantly underrepresented in County employment comprising only 11 (7.5%) and 40 (27.4%) respectively compared to 
their availability in the civilian labor force of 12% and 34.9%. 

Evidence clearly indicates a similar underrepresentation of 
blacks and women in the County Sheriff's Department. While there 
dre 26 sworn deputies, only 2 or 7.7% are black. There are no 
female deputies in the Sheriff's Department. 

Further investigation revealed that of 52 nonelected, full- 
time employees earning $700 or more per month, only one or 1.9% 
is black. This figure reflects the concentration of blacks in 
lower paying, less responsible positions. 

The evidence gathered also disclosed that the County appears 
to have done Tittle to recruit blacks or women for postions with 

“the County government. Since 1972, the County has hired only 
six (6) blacks who are still employed by the County. Of forty- 
seven (47) skilled and unskilled laborers employed by the County's four (4) Road Districts, only two (2) or 4.2% are black. Further 
examination disclosed that the districts have hired at least 
eight (8) employees since 1972 who are presently employed. None 
of these are black. :   

The County's employment application form contains preemploy- ment inquires regarding: birthplace, height and weight, physical handicap or impairment and marital status. Such inquiries have 
been shown to be discriminatory against various minorities and women. 

b) Remedy 

Submit an affirmative action plan to the Office of 
Revenue Sharing for approval. The plan shall include goals and timetables for the employment of women and minorities in all departments/districts in percentages which reflect their availabi- lity in the County's labor market which is 12% minority and 34.9%

women. The plan shall also provide for specific methods to recruit minorities and women for employment (inall positions in all depart- ments/districts) with the County, including the Sheriff's Depart- i ment. 

; Take immediate steps to ensure that all applicants for employ- = ment with Etowah County are selected on the basis of their quali- oh fications not their race, throughout the County government, including 5 | the Sheriff's Department. : : FRSA i Hin 
EVE : Eliminate the preemployment inquiries cited above in the County's (a > employment application form, or provide this Office evidence that ¥ the inquiries are job related and have been validated. 

This Office is aware that Etowah County is divided into appro- ximately eighteen departments or districts. However, a review of the evidence disclosed that all eighteen departments or districts are recipients of entitlement funds. Etowah County is therefore advised that the findings of fact and remedies contained in this i document are applicable to all units of the Etowah County government. 

Submit. annual reports to the Office of Revenue Sharing de- : scribing the progress made during the previous year to select and upgrade minorities and women in the work force. The report shall pe also include a current roster of all full-time employees by depart- ment/district indicating name, race, sex, date of hire, starting “ position, starting salary, present position, present salary, and last date of promotion.

The County Commission of Etowah County hereby declares it to be the *~ 
policy of Etowah County to provide equal cpportunity in emcloyment and 

advancement, and to administer its employment policies without regard to 
race, color, religion, sex, age or national origin. 

The policy of no discrimination will prevail throughout every aspect 
of employment practices including, but no limited to, the following: 

i. Etowah County will recruit, hire and promote in all job classi- 
fications without regard to race, color, religion, sex, age or 
national origin, except where sex or age is a bona fide occupa-

All decisions for hiring or promotions shall be based solely upon 
each indivicual's qualifications for the position to be filled. 

All other personnel actions such as compensation, benefits, trans- 
fers, layoffs, returns from layoifs, county-sponsored training, 
education, tuition assistance, social and recreation programs will 
be administered without regard tc race, cclor, religion, sex, age 
or national origin. : : 

Etowah County will undertake a program of affirmative action to

Due to the current fiscal situation in Etowah County, and 

in Alabama Counties generally, theve can be no realistic pro- 

jection of expansion either in County avy ican or employment

of County employment must be based on normal attrition and pro-

JOB STEREOTYPING 

The County admits that certain sex stereotyping generally 

exists both in County employment and in the surrounding labor | 

market. The traditional mele designation as road repairman, 

maintenanceman, policeman, messenaor boy and yardman are in the 

past and so are the artificial barviers for employment. Cinuin

position or failure to resolve.

creed, sex, national origin, or age.
