AN ACT
To make a further and additional appropriation of $44,000 to the
Deparment of Adult Blind of the Alabama Institute for Deaf and
Be It Enacted by the Legislature of Alabama:
Section 1. There is appropriated the further and ad-
ditional sum of $44,000 to the Department of Adult Blind of the
Alabama Institute for Deaf and Blind out of the Special Edu-
cational Trust Fund, from any such funds not heretofore
appropriated.
Section 2. This act shall become effective immediately
upon its passage and approval by the Governor, or upon its
otherwise becoming a law.

Act No. 119 H. 24—Berryman (R)
AN ACT
Relating to the government of Lawrence County; abolishing the
Board of Revenue of Lawrence County created by Act No. 18, S. 2, ap-
proved May 18, 1951, and establishing in lieu thereof the court of
county commissioners; providing for the organization, powers, jurisdic-
tion, and duties of the court of county commissioners, and for the qualifi-
cations, manner of election, and compensation of its members; regulating
the county purchasing procedures; proscribing certain uses of county
property; and prescribing penalties.
Be It Enacted by the Legislature of Alabama:
Section 1. The board of revenue of Lawrence County

created by Act No. 18, S. 2, approved May 18, 1951, is aboljshed,
and there is established in lieu thereof a court of record,(styled—
the court of county commissioners of Lawrence County, which
shall be composed of the judge of probate, as principal judge,
and four commissioners, who shall be elected as hereinafter
provided.
Section 2. Lawrence County is hereby divided into four
commissioners’ districts for the purpose of electing members of
the court of county commissioners, as follows:
The northeast district of the county shall be that portion of
Lawrence County lying east of the line between Ranges 7 and 8
and north of the section lines which are parallel to and,
approximately, one (1) mile south of the line between Town-
ships 5 and 6.
‘The northwest district of the county shall be that portion
of Lawrence County lying west of the line between Ranges 7
and 8 and north of the section lines which are parallel to and,
approximately, one (1) mile south of the line between Town-
ships 5 and 6.
The southeast district of the county shall be that portion of
Lawrence County lying east of the line between Ranges 7 and
8 and south of the section lines which are parallel to and,
approximately, one (1) mile south of the line between Town-
ships 5 and 6.
The southwest district of the county shall be that portion
of Lawrence County lying west of the line between Ranges 7
and 8 and south of the section lines which are parallel to and,
approximately, one (1) mile south of the line between Town-
ships 5 and 6.
A county commissioner shall be nominated and elected for
each district by the qualified electors of the district. Com-
missioners for the northeast and northwest districts shall be
elected at the general election to be held in November, 1968,
and every four years thereafter; commissioners for the south-
east and the southwest districts ‘shall be elected at the general
election to be held in November, 1970, and every four years
thereafter. Each commissioner shall be a resident and qualified
elector of the district for which he is elected, and shall continue.
to reside therein during his continuance in office.
Section 3. The members of the board of revenue of Law-
rence County elected to the board from the four districts herein
described may serve as members of the court of county com-
missioners, for the pay provided in Section 5, until commission-
ers are elected and qualified as in this Act provided. The

commissioners elected under the provisions of this Act shall
hold office for terms of four years from the first Monday after
the second Tuesday in January next succeeding their election,
and until their successors are elected and qualified.
Section 4. Except as otherwise provided herein and in
Act No. 326, H. 109, of the Special Session of 1966, the court of
county commissioners provided for in this Act shall have and
exercise all the jurisdiction and powers which are, or hereafter
may be, vested in courts of county commissioners by the general
laws of the State, and the members of the court shall perform
all the duties and services and exercise all the powers which are,
or hereafter may be, provided by law for members of courts of
county commissioners. The court, in addition to the foregoing
and without any limitation thereon, shall have and exercise the
following jurisdiction, power, and authority, viz: (a) To levy
all taxes, both general and special, authorized or required by
law: (b) to make adequate provision for the support and
maintenance of the indigent and insane of the county; (c) to
make adequate provision for preserving the public health and to
this end to make contribution as it sees fit to any hospital or
similar institution within or without the county for charity
patients who are resident citizens of the county and to take such
action as may be necessary or appropriate to prevent, control,
cure and eradicate all disease and causes thereof and to provide
for the quarantine of persons suffering from infectuous or
contagious disease; (d) to supervise, oversee, manage, repair,
maintain, and control all property of the county including the
courthouse and jail, and to furnish all necessary light, heat, and
janitor service therefor, and to supply to the several officers
of the county such stationery and supplies as may be necessary
for the proper handling of the business of the county; (e) to
employ an auditor and an attorney, and prescribe the duties and
fix the compensation of each; and (f) to examine, audit, and
allow or disallow, settle, and pay all claims and demands against
the county.
Section 5. Each member of the court of county commission-
ers shall receive an annual salary of one thousand eight hun-
dred dollars ($1,800), which shall be paid in monthly install-
ments. Such salary shall be the only compensation or allowance
of any kind to be received by the commissioners. The duties
hereby imposed on the judge of probate of Lawrence County
shall be ex officio duties and he shall not be entitled to any
compensation for the performance thereof.
Section 6. The court of county commissioners shall hold
regular meetings at the courthouse of said county on the second
Monday of each month and such special meetings as the business

of the county requires may be held upon the
At any meeting the business of the county shall be taken up,
considered and transacted in due order, and the meeting may
be adjourned to a day certain. The chairman shall keep or
supervise the keeping of the minutes of the acts and proceedings
of the court in a well-bound book. He is, however, hereby
specifically authorized to employ a clerk to whom he may
delegate any clerical or purely administrative duty hereby placed
on him. Such clerk shall be paid a salary of four hundred dollars
per month out of the general fund of the county. The chairman
shall fix and prescribe the duties of the clerk hereby authorized.
Section 7. All purchases of all “books, stationery, paper,
blanks, blank forms, blank books, supplies, appliances, fixtures,
furniture, typewriters, and all other equipment required by the
probate judge, sheriff, register, clerk of the circuit court, county
superintendent of education, tax collector, tax assessor, and
court of county commissioners, or the chairman thereof, for
their respective offices, and also supplies of any kind or des-
cription, materials, appliances, equipment, fuel and coal for the
county courthouse, jail, and any other county building, and any
county officer, shall be made only upon orders of the court
entered upon the minutes of the court at a regular meeting of
the court held on Monday in the manner hereinafter prescribed.
Such orders of the court shall specify the article or articles to
be purchased, the number or quantity thereof, and shall contain
a specification and description thereof sufficient to enable the
chairman to give the notice hereinafter required requesting bids
for such article or articles. Within two days after such order
of the court, that is, on or before the Wednesday following, the
chairman shall post upon a bulletin board to be situated immedi-
ately inside or outside his office in the courthouse a notice,
called a purchase notice, which shall state that the court has
ordered the purchase of the article or articles described in the
order of the court for delivery at a place or places to be specified
in said notice, and that sealed bids therefor will be received
by the court during the seven days immediately succeeding,
unless the court in its order provides that a longer time be
specified as the time within which bids will be received. All
purchase notices shall be numbered consecutively and shall be
made out in duplicate, and one copy thereof shall be retained as
a permanent record and shall contain a certificate of the chair-
man as to the date of the posting of the other copy thereof
upon the bulletin board. At the expiration of the time fixed
for receiving bids, the chairman shall open the bids and shall
report all bids to the court at its next meeting, and thereupon
the court may either accept the lowest responsible bid and order
the chairman to issue a purchase order in accordance therewith

or direct the chairman to obtain other and further bids in the
manner hereinabove provided. All sealed bids received by the
chairman shall be opened in his office and shall be open to
public inspection as opened, and the opening of bids shall
commence at 10 o’clock A. M. on the Wednesday following the
date on which invitations to bid were posted. All purchase
orders shall be numbered consecutively and shall be made out
in triplicate, and shall state the number of the purchase notice
pertaining thereto, and shall contain a description of the
property to be purchased, the price therefor, the place where
delivery is to be made, and such other matter as the court may
prescribe. One copy of said purchase order shall be delivered
to the seller and one copy thereof shall be forwarded to the
person who in behalf of the county is to receive the property
purchased, and the other copy shall be retained with the records
of the court. The person who is to receive the property pur-
chased in behalf of the county shall upon receipt thereof, endorse
upon the copy of the purchase order forwarded to him, upon a
form to be prescribed by the court, the facts as to whether or
not all of the property described in said purchase order was
received by him, and as to the condition in which the same was
received, and shall deliver said copy to the chairman within five
days after the receipt of the property involved. Every claim
filed against the county for the purchase price or value of any
of the goods or articles hereinabove specified, shall state the
number of the purchase order pertaining to said claim. Neither
the chairman nor the court shall have authority to accept any
bid unless at the time of accepting the same the county has
funds on hand sufficient to pay for the same.
Section 8. Any and all contracts made and entered into to
purchase, or purchases made by the court or any member of
the court, or any officer or agent of the county, of any of the
property specified in the preceding section shall, except as
herein otherwise provided, be null and void, and it shall be
unlawful for a warrant to be issued in payment of the same
unless such property shall have been purchased as provided in
the preceding section and unless the steps provided in said
section preliminary to making any purchases shall have been
had, and the said county of Lawrence shall not be liable in any
form of action, or suit, whatsoever for the price or value or
use of any such article or property sold or delivered to it or to
any of its officers or agents in violation of the preceding section.
Section 9. After the approval of this Act, no lease-sale
contract, or contract for the rental or hire of any of the property
mentioned in Section 7 of the Act shall be made by the court,
or any member thereof, unless such contract be authorized by
resolution or order of the court made at a regular meeting of

the court, and entered on its minutes, which resolution or order
shall be made only upon the favorable vot 11 m
the court. Such order or resolution of the court must have been
passed before the delivery of the property involved and other-
wise shall be void. Any and all lease-sale contracts, or contracts
for the rental or hire of any such property, not made in con-
formity with the foregoing provisions shall be null and void
and it shall be unlawful for a warrant to issue in payment of
the rental or hire or use thereof and the said County of Law-
rence shall not be liable in any form of action or suit whatsoever
for the rental or hire or use of any of such property except
under and by virtue of an express contract made as provided in
this section.
Section 10. The court shall have charge of the equipment
and fixtures contained in the courthouse, jail and other public
buildings and offices of the county, and shall have authority to
cause repairs to be made to said buildings and to the equipment
and fixtures therein, and the county shall be liable for the cost
of the same, not to exceed, in any event, more than the reason-
a,
able value of such repairs. The court shall also have authority —
to purchase medicine and medical supplies and arrange for
medical attendance for the prisoners in the county jail and also
to contract for the burial of paupers and the county shall be
liable for the reasonable cost of the same without regard to
Section 7 of this act. Stamps, electricity, water, and telephone
service, or any other service furnished by a public utility whose
rates are regulated by law, may be provided for the public
offices and building of the county by the court without regard
to the provisions of Section 7 of the act. The court shall also
provide janitor service for the courthouse of said county.
Section 11. The chairman of the court shall keep or super-
vise the keeping of all books and records herein required, as
well as the books and records required to be kept by the general
laws of this State. He may, however, delegate such of his duties
in this connection as are purely clerical to the clerk, whom he
is authorized by Section 6 hereof to employ.
The court shall provide for itself and for the chairman
suitable office space in the courthouse, and shall obtain an
official seal, containing the name of the court and the words
“Official Seal,” which shall be kept by the chairman. The office
of the chairman shall be kept open from 9 o’clock a. m. to 4
o’clock p. m. on all days except Sundays and holidays and except
on one day during each week, to be designated, by the court, on
which day said office shall be open from 9 o’clock a. m. until
noon.
Section 12. Each member of the court from the four

districts before entering upon the duties of his office shall make
and file with the clerk of the circuit court of Lawrence County
an oath of office and a bond in the penal sum of $5,000, payable
to Lawrence County, with sufficient security to be approved by
the clerk of the circuit court. The judge of probate of Lawrence
County before entering upon his duties as chairman of the court
of county commissioners shall also take and file a special oath
of office as such chairman and a bond in the penal sum of
$5,000, payable to Lawrence County, with security to be ap-
proved by the clerk of the said circuit court. Said bonds shall
be conditioned for the faithful performance of the duties of
the respective offices and shall be recorded as required by law.
The reasonable premiums for such bonds shall be paid by
Lawrence County.
Section 13. Any vacancy in the office of commissioner
from either of the four districts shall be filled by appointment
of the governor for the unexpired term.
Section 14. The salaries of the commissioners from the
four districts and the salary of the clerk employed by the
chairman as authorized in Section 6 of this Act shall be paid
out of the general fund of the county.
Section 15. Lawrence County shall not borrow any money
nor shall it issue any tax anticipation warrants nor pledge any
future taxes without the affirmative vote of at least three of
“the commissioners from the four districts.
Section 16. The office of chairman of the board of revenue
of Lawrence County, created by and existing under said Act No.
18, S. 2 of the Regular Session of 1951 (Acts 1951, p. 320) is
hereby abolished. After this Act becomes effective, except as
hereinafter provided, such chairman shall not have or perform
any further duties or functions with reference to the governing
body of Lawrence County, nor shall he be entitled to any com-
pensation for any such functions and duties. After this Act
becomes effective and as soon as the judge of probate of Law-
rence County has taken and filed the oath as chairman of the
court of county commissioners and his bond has been approved,
all as required in Section 12 of this Act, the chairman of said
board of revenue shall deliver to the judge of probate all books,
records, papers and documents of and pertaining to the board
of revenue of Lawrence County.
Section 17. No county equipment or material shall be used
for the benefit of any individual, firm or private corporation,
either for a consideration or otherwise, and any member of the
court of county commissioners or employee of the county who
violates this section of this Act shall be guilty of a felony and

upon conviction shall be punished by imprisonment in the
penitentiary for a term of not less than two years and not more
than ten years.
Section 18. Act No. 18, S. 2, approved May 18, 1951 (Acts
of Alabama 1951, p. 220) and all acts amendatory thereof and
also any and all other laws or parts of laws in conflict hereby
are hereby repealed.
Section 19. The provisions of this Act are severable. If
any part of the Act is declared invalid or unconstitutional, such
declaration shall not affect the part which remains.
Section 20. This Act shall take effect July 1, 1967.

AN ACT
To authorize the governing body of any county or municipality to
appropriate public funds and to use certain equipment and employees
in aid of certain projects undertaken in any other contiguous county, or
the home county of said governing body.
Be It Enacted by the Legislature of Alabama:
Section 1. The governing body of any county or any
municipality in this state is hereby authorized, upon the
adoption by majority vote of a resolution duly recorded in its
minutes, to aid and participate in the development of any access
roads or bridges to any project undertaken by any public
athletic or recreational board for the promotion of athletics,
recreation, race tracks, and related facilities in any other con-
tiguous county or in aid of the development in any other con-
tiguous county of any industrial site or access roads and bridges
of any project undertaken pursuant to the provisions of Act
No. 648, S. 518, Regular Session 1949 (Acts 1949, p. 991) or
pursuant to Act No. 756, H. 756, Regular Session 1951 (Acts
1951, p. 1307). Any county, including the county in which said
project is located, the governing body may appropriate county
funds or authorize the use of equipment and employees of the
county to aid in the promotion of any project which comes
within the purview of this Act, and any municipal governing
body may likewise appropriate municipal funds or authorize
the use of equipment and employees of the municipality to aid
in the promotion of any such project.

Section 2. In addition to all other compensation and allow-
ances heretofore or hereafter provided by law, the judge of the
county court in every county in which this act applies shall be

of Lawrence County and provides for the organization, powers, juris-
diction and duties of such court and for the qualifications, election and
compensation of the members thereof, amending Section 2 of such act
in order to provide for the nomination and the election of members
of such court of county commissioners by the county at large.
Be It Enacted by the Legislature of Alabama:
Section 1. Section 2 of Act No. 119, H. 24 of the Special
Session of 1967 (Acts of 1967, p. 166) is hereby amended to read
as follows:
“Section 2. Lawrence County is hereby divided into four
commissioners’ districts for the purpose of electing members of
the court of county commissioners, as follows:
“The northeast district of the county shall be that portion
of Lawrence County lying east of the line between Ranges 7 and
8 and north of the section lines which are parallel to and, approxi-
meiely, one (1) mile south of the line between Townships 6

Section 1. Section 1 of Act No. 272, H. 688, Regular Session
1949 (Acts 1949, p. 899) is hereby amended to read as follows:
“Section 1. The coroner of Lawrence County shall receive
as his compensation and for other expenses and ex officio services
the sum of $75.00 a month. Such compensation shall be paid in
equal monthly installments out of the general fund of the county
upon warrants issued by the governing body of said county.”
Section 2. This act shall become effective upon the expira-
fon of the term of office of the incumbent coroner of Lawrence
ounty.

3. Breakdown of expenditure of Revenue Sharing
Funds. (FY1981-82 thru Eeb.1985)
No revisions have been made in our Persormel Policies and Procedures
since submitted in May, 1983. However, we would like to advise you that
the Lawrence County Commission is now under a new administration since
January 14, 1985, and the new administration is well aware that the
black population is not adequately reflected én our work force. One
black male was hired in March and we foresee three vacancies on our work
force within the next month. We have instructed department heads to
hire black employees to fill these vacancies, and all future jobs until
our goal of 17.1% black personnel is reached. = We are very concerned
about this situation and will make every effort tO see that it is correc-
ted.

By letter dated July 28, 1981, our Office notified you that
we have received a complaint which alleged that entitlement funds
have been used by your government in a manner in violation of 31
U.S.C. 6716 (formerly 31 U.S.C. 1242(a) and Section 122(a) of the
state and Local Fiscal Assistance Act of 1972, as amended).
Specifically, it was alleged that the black population of Lawrence
County, Alabama are not afforded equal opportunities for employment
and that the County discriminates in its hiring practices; that the
17.1% black population is not reflected in the County's work force;
and that of the four blacks employed by the County, one male is a
deputy sheriff, one male is a custodian, one female is a clerk
in the Probate Office, and one female is a CETA employee in the
Tax Assessor's Office.
By letter dated April 14, 1983 to you, it was confirmed that
certain information and documentation be submitted to this Office.
We received your response to that letter on May 12, 1983. Due to
a reorganization of the Civil Rights Division on June 11,1983,
another branch within the Division has the responsibility of
investigating complaints filed against governments located in the
State of Alabama.
This is to advise you that Ms. Jean Smith, a Civil Rights
Investigator, has now been assigned the responsibility of
investigating and resolving this matter. In order to/continue
the investigative process, Wwe have included a copy of our original
request for information.
At this time we would like to bring our file up to date. In.
keeping with the items listed in our original request, please sub-
mit the following additional information:
1. Provide a current’ employee roster. The specific data is
noted in item #1 of our original request.
2. Provide a revised list of all appointed officials and
part-time employees if there have been any changes from
what we already have on file.

Lawrence County Personnel Policies and Procedures.
Also provide any revisions to the Affirmative Action

5. Provide a specific breakdown showing where revenue
sharing funds have been used in Lawrence County from
1982 to the present.

Our County adopted an Affirmative Action Plan in July, 1980. At
that time, we had 6 blacks employed. Our Affirmative Action Paln
includes a goal to be reached at the end of our second year (1981)
of 13 minority employees and as stated above, we now employ 11.
Our goal has been reached in all departments except the Road Main-
tenance Department, but due to extreme shortage of funds, no new
employees have been hired in this department since the implementa-
tion of our Affirmative Action Plan, with the exception of a few
CETA participants who were hired by the County at the end of the
CETA program.

INTRODUCTION
The Affirmative Action Plan for Lawrence County Commission is
the mechanism by which equal employment opportunity may be assured for

The County Commission of Lawrence County
Moulton, Alabama
The County Commission of Lawrence County hereby declares it to be the
policy of Lawrence County to provide equal opportunity in employment and
advancement, and to administer its employment policies and practices without
regard to race, color, religion, sex, age, handicap or national origin.’
The policy of non discrimination will prevail throughout every aspect
of employment practices including, but not limited to, the following:
1. Lawrence County Will recruit, hire and promote in all job classi-
fications without regard to race, color, religion, sex, age,
handicap or national origin.
2. All decisions for hiring or promotions shall be based upon each
individual's qualifications for the position to be filled.
3. All other personnel actions such as compensation, benefits, trans-
fers, layoffs, returns from layoffs, county-sponsored training,
education, tuition assistance, social and recreation programs will
be administered without regard to race, color, religion, sex, age,
handicap or national origin.
4. Lawrence County Will undertake a program of affirmative action to
make widely known that equal employment opportunities are available
on the basis of individual merit and to actively encourage all
persons to seek employment and to strive for advancement on this
basis.
5. Lawrence County will conduct an annual survey and an analysis of
the employee work force to ascertain what measures, if any, may
be needed to effectively maintain conformance with this equal

6. It is the intent of the Lawrence County Commission that this
policy shall be enforced the same as any other policy of the
Commission. Any deliberate attempt to thwart or to circumvent
this policy shall be grounds for disciplinary action, including
demotion or discharge.

and compliance with its provisions shall be pre-requisite to receiving
funds from the Lawrence County Commission. A copy will also be furnished

The County Commission of Lawrence County

WHEREAS, the Lawrence County Commission desires to provide quality
services to the citizens of Lawrence County; and
WHEREAS, the Commission is dédicated to providing equal opportunity
for employment to all qualified applicants and fair treatment
for all employees; and
WHEREAS, the Commission believes that continuance of employment with the
County should be based on satisfactory performance of duties;
NOW, THEREFORE, BE IT RESOLVED that the County Commission of Lawrence County
does hereby adopt and proclaim the following personnel policies:
Equal Employment Opportunity
A. Lawrence County is an equal opportunity employer (M/F) and does not
discriminate in any employment policies or practices on the basis
of age, sex, race, creed, religion, color, point of natural origin,
Handicap, marital statusy political belief or affiliation,
Lawrence County Will attempt to provide, through an Affirmative

C. Lawrence County Will initiate and support a recruitment program to

II Conditions of Employment
Lawrence County will develop a discription of each job/position in
the County service, with a list of representative tasks normally
assigned to or associated with the job/position, and with a
statement of minimum anticipated job outcomes.

I. The County believes that the goal of productivity in county
employment will be served by establishing a probationary period
for new employees during which the employee is oriented to all
the conditions and requirement of county work and during which his/her
+ performance is closely supervised and monitored to assure the attain-
ment of the minimum performance requirements for the job/position.
Probationary employees and share in all the benefits of employment
~. with the county except that dismissals for cause during the pro-
bationary period shall not be grievable.
IIT. Employee Benefits
A. Lawrence County will develop a job classification and pay plan which
will include every employee and which will:
1. be based on the type and quality of work performed.
2. provide "like pay for like jobs."
3. be comparable when possilbe to similar employment situations
in the community.
B. The County will provide, to the maximum extent possible within
its financial capability, holidays, sick leave, vacation leave,
insurance, and retirement benefits and other appropriate fringe
benefits comparable to those found in comparable community employ-
ment. Such fringe benefits will be provided equally without regard to
race, age, sex, marital status, religion, creed, political belief
handicap or point of natural origin.
C. The County will offer in-service training opportunity for the purpose
of encouraging employees to become able to assume greater job responsi-
bility and to gain greater satisfaction from job performance. The
County will cooperate with Community agencies, public and private, to
assure the greatest possible benefit from training for job performance
and upward mobility.

V. Lawrence County employees may, and are encouraged to participate
fully and actively in the political processes except as prescribed by
law. In general, County employees are restricted in their political
activities only in campaigns for County office and in their on-the-job
political activities for any candidate for any office. The employer
will advise all employees of their rights and of
applicable restrictions, and no employee shall in any way be penalized
for permitted political activity or lack thereof.

Assurance of Compliance
The Lawrence County Commission, governing body of Lawrence County,
hereby assures that in its administration of funds in its provision of:
services in local, State, or Federal financial assistance, or the
administration of any program or activity for which it receives Federal
financial assistance from or through the Department of Labor or any other
Federal Agency, it will comply with all applicable laws and regulations
To this end, the County agrees:
RECRUITMENT
That effective immediately, the County, its agencies and
departments and divisions, will actively recruit by:
A. Posting all entry-level vacancies with the Alabama State Employment
Service; the Courthouse and Courthouse Annex bulletin boards; community
and public agencies interested in the promotion of minority employment;
food stamp distribution center; Department of Pensions & Security, and
the Director of Lawrence County CETA/Work Experience Program.
Posting vacancy notices for positions above the entry Tevel first
on employee bulletin boards and in other areas conspicous to County
employees.
If no applicant is found amoung the County's existing regular, full-
time employees eligible for promotion of transfer, the vacancy notice
will be placed with the Director, Lawrence County CETA/Work Experience
Program.
If no eligible application is found among the CETA/Work Experience
Program participants, the vacancy will be advertised as in ( A. this
Section). In addition, classified ads may be placed in newspapers
and trade/professional journals.
IT. HIRING PROCESS
A. That the County will not select any individual for employment
or training on the basis of any job request whick contains
discriminatory specifications with regard to any impermissible
criterion, and that where a job specification or other require-
ment has the necessary effect under the circumstances of dis-
criminating on the basis of an impermissible criterion the
County will not honor such a job specification or order.
B. That minority group applicants will be viewed according to
their aptitudes, experience, and interests rather than according
to traditional occupational patterns for minority group persons.

C. That female applicants will be viewed according to their aptitudes,
experience, and interests, rather than according to the traditional

D. That employment aptitude and proficiency test- will be administered
without regard to race, color, sex, or other impermissible criterion

in conformity with instructions and guidelines issued by the Bureau
of Employment Security.
E. That in the taking of applications for jobs, local office functions
will be performed according to the same standards for all applicants
without regard to any impermissible criterion. To this end, the
County agrees that when a minority member or female is being inter-
viewed: (a) the interview will be conducted in accord with policy
and standards set forth for all applicants; (b) information
required for job placement will be obtained and recorded accurately;
(c) no record or identification, by code or otherwise, will be made
of the race, sex, national origin or any other impermissible
characteristic/criterion of the applicant except as required for
Federal reporting; and (d) applicants will be provided with all
information pertinent to their registration for work.
F. That all vacancies, including regular full-time, part-time,
seasonal, and special project vacancies shall be handled in the
same manner, and that in the employing of other than regular, full-
time employees, the County will disseminate information about
permanent openings or other training opportunities.
G. That the dissemination of information about, and the registration,
testing and selection of persons for jobs will be conducted by
the County in such a manner as to ensure that all qualified
applicants are selected and referred without regard to any
impermissible criterion.

EMPLOYMENT PRACTICES
A. That all employment policies, practices, regulations rules and
benefits shall be applied and shall accrue without regard to race,
sex, color, handicap, national origin, religion, or any other
impermissible criterion.
That the County has developed uniform job descriptions and wage/pay
scales for all County employees according to job classification
and that such descriptions, classifications and pay scales have
been emplemented.
The County has prepared and disseminated to all County employees
an Employee Handbook outlining all policies, rules, regulations,
and benefits governing and accruing to its employees.
That the County will not employ any criterion or utilize any
‘method of administration which will have the effect of assigning
any job classification or description, or any applicant therefor,
on the basis of any impermissible criterion.
That the County will operate all County facilities without
distinction based on any impermissible criterion.
That the County will inform and instruct the staff of all its
offices concerning their obligation(s) under Title VI of the
Civil Rights Act of 1964, and will furnish a copy of the Labor
Department's Rules and Regulations and a copy of this Assurance
and Affirmative Action Plan to all such staff.
GENERAL
A. That the County will inform the general public of the fact that
services and other benefits under all programs are provided on
a nondiscriminatory basis and of the right of any person or group
to file a complaint with the Secretary of Labor if it is believed
that impermissible discrimination is being practiced.
That the County will regularly review the practices within all its
departments, divisions and agencies to assure that personnell
policies and practices are in conformity with the Regulation, with
this Assurance, and with the Affirmative Action Plan.

C. That the County will maintain such records as are required by
local, state and/or Federal law or regulation and will submit
such reports as may be required to insure compliance.
D. That all facilities of the County, including its records, books,
accounts, and other sources of information pertinent to the
ascertainment of the County's compliance will be available at
any time during normal business hours for inspection by a
Department of Labor representative authorized to make such
inspection(s).
E. That a copy of these Assurances will be furnished to all vendors,
contractors, and sales representatives desiring to do business
with the County, with the understanding that Lawrence County will
purchase from, let bids to, or otherwise do business only with
Equal Opportunity employers.
EEO Program Responsibilities
In order to enhance the effectiveness of Affirmative Action efforts, an
Equal Employment Opportunity Officer shall be designated,whose responsibility
it shall be to assure compliance with EEO gudelines and the implementation of
approved Affirmative Action activities for both the County Commission and its
County Divisions.
A. To this end, functions of the EEO Officer shall be:
1. to promote and implement the County's Affirmative Action Plan.
2. to provide technical assistance and guidance to elected officials
and divisions heads in the implementations of the Affirmative
Action Plan.
3. to advise administrators, officials, and managers on EEO laws
and regulations and to coordinate the development of County
policies in conjunction with such laws and regulations.
4. to conduct pre-award compliance reviews in order to determine
the current EEO postures of Departments/divisions.
5. to receive and investigate complaints of descrimination.
6. to compile and analyze statistical data for the purpose of
monitoring and evaluating progress of EEO activities at
County and Division levels.

7. to provide and/or assist in the provision of training to
County staff and Division staff in the area of EEO require-
ments and responsibilities.
8. to report periodically to the County Commission on the
status of EEQO/Affirmative Action activities.
9 to maintain working relationship with government and
private civil rights and community organizations involved
in job placement and the furtherance of equal employment
opportunity.
10. to prepare annual assessment of EEO program activities in
terms of plan versus accomplishments.
B. Supervisors and unit heads will be expected to familiarize
themselves with the Affirmative Action Plan and to apply
EEO/Affirmative Action Plan policy requirements to assure that
equal employment opportunity in all aspects of employment is
received by all employees and potential employees.
Dissemination of Policy
Internally
1. Written communication from the Chairman, Lawrence County
Commission, to all employees emphasizing County Government's
committment to Equal Employment Opportunity/Affirmative
Action, including the statement of policy in this regard.
2. Written communication from the Chairman to Elected Officials/
Unit Heads stressing their responsibilities for exercising good
faith efforts to carry out affirmative action within their units,
to include distributing copies of affirmative action plan to all
supervisors and unit heads.
3. Inclusion of Affirmative Action/Equal Employment Opportunity
section in employee orientation/training.
4. Posting of policy statement throughout the county's facilities.
Externally
1. Copies of the County's Affirmative Action Plan will be distributed
to all agencies which receive financial assistance from the County
or who supply goods or services to the County.
2. Agencies will be assigned the responsibility of explaining Equal
Employment Opportunity/Affirmative Action policy to participants.

FINDING OF FACT
Data available as of September 1978, indicate that the County
is not presently serving blacks and women at levels equal to their
proportions in the labor force. Lawrence County assumed control of
its road system from the State of Alabama on October 1, 1979. At
that time all employees transferring from the State to Lawrence
County under a mandatory state law were white males. There were no
minority members on the State road crew. This factor has contributed
greatly to the disproportionate number of white males in our work
force. It will be the responsibility of the County Commission and
other elected officials, by means of reviews to insure that the
hiring of employees is administered on a non-discriminatory basis, as
well as insuring that proportions consistent with labor force
characteristics are reached.
