Statement by Jack Greenberg, Director-Counsel NAACP Legat-Defense and Educational Fund, Inc, 10 Columbus Circle, New York City, Feb. 9,1967 The future of school desegregation throughout the South will be significantly affected by the outcome of a rehearing announced today by the Fifth Circuit Court of Appeals in seven key Legal Defense Fund suits. The outcome of the impending hearing before the entire Fifth Circuit Court will have far-reaching effects on the 175 school de- segregation cases presently handled by the Legal Defense Fund. Our attorneys are representing the interests of two million Negro children in the South. Prompted by the Fif th Circuit's December 29, 1966 ruling, we moved to reopen most of these cases so as to bring them up to the standards prescribed in the desegregation guidelines of the Depart- ment of Health, Education and Welfare. Inasmuch as every major city in the South, plus a large number of rural communities, are under court orders which will be governed by the impending Fifth Circuit decision, today"s action represents the most important judicial move in recent desegregation history.
