January 30, 1969. 

HEW Secretary Finch's decision not to cut off federal funds 

from five southern school districts which have refused to submit 

adequate desegregation plans, even though they were warned to do 

so almost a year ago, is disastrous. 

Passage of Title VI in 1964 provided an extremely important 

weapon by which southern school boards are made to comply with 

the historic 1954 Brown decision requiring school desegregation. 

School desegregation has multiplied since 1964 largely as a 

result of Title VI. 

There are presently not enough lawyers to file necessary 

suits to effect broad désegregation; and, even so, court enforces 

ment is not as effective as withholding of funds. 

Today's action can only provide encouragement to, and harden 

the resolve of, southern school officials to continue their efforts 

to evade the law.

NOTE: The Legal Defense Fund, through its network of cooperating 
attorneys, is handling 225 education cases across the South 
to secure compliance with the 14-year-old Brown decision.
