This Site is made available by NAACP LDF (Legal Defense & Educational Fund, Inc.), a 501(c)(3) non-profit corporation, incorporated in New York State (“LDF”). From time to time, LDF may revise these Terms without giving prior notice. If LDF makes such revisions, an updated version will be posted on the Site. By continuing to use the Site after the updated version has been posted, you agree that you accept any changes in the updated Terms.  

This Site contains a digital archives collection and original editorial content related to LDF’s current and historical role in civil rights advocacy. It is provided to the general public for informational and educational purposes only. If you are seeking information about LDF legal services or representation, please visit LDF’s main website.  

Intellectual Property 
LDF owns the compilation of content that encompasses this website, including its texts, images, audio, video, design, databases, codes and software, as well as the general “look and feel” of the Site (“Content”.) This does not mean that the LDF owns each item of Content or the intellectual property rights attached to each component of Content. In these cases, Content and intellectual property rights are used with the owners(s) permission or in accordance with applicable law.

By using the Site, you signify your acceptance of the LDF Privacy Policy, as may be updated by LDF from time to time.  

Applicable Law  
These Terms and any legal action brought against the LDF shall be governed by the laws of the State of New York without regard to its conflicts-of-law rules. You also waive any objections to venue of any such litigation in courts located in New York City and agree not to plead or claim that New York City is an inconvenient forum. Any claim by you that may arise in connection with these Terms will be compensable by monetary damages and you will in no event be entitled to injunctive or other equitable relief. You also hereby expressly waive any right to resort to any form of class action. 

Notice & Takedown Policy  
LDF employs policies and processes intended to prevent the display of materials on the Site that infringe on an individual’s privacy, or that are in violation of copyright law. If you find materials that should not be publicly available for these reasons, please contact us to request removal by emailing our Archives Department at info@ldfrecollection.org and include the following information in your message: 

  • Your contact information
  • The reason for the removal request (nonpublic personally identifiable information, intellectual property infringement, etc.)
  • The relevant url(s) for staff to locate the materials. Sufficient information for our staff to locate the materials, including the url(s). 

General 
These Terms contain the entire agreement between you and LDF regarding your use of the Site and supersedes all previous agreements (if any). If a court or other valid authority determines that any provision of the Terms is void, invalid, unenforceable, or illegal, such provision(s) will be ineffective only to the extent of such invalidity or unenforceability and the validity and enforceability of the other provisions will remain and not otherwise be affected. If LDF does not enforce any provision of the Terms, that will not constitute or be construed as a waiver of such a provision or it right to enforce it.
