PER CURIA}.I:

Defendants appeal the district courtrs grant of writs

of habeas corpus on plaintiffs' motions for summary

judgment.

Both Maggie S. Bozeman and Julia P. Wilder were

convicted of three counts of vote fraud in stat,e court in

Pickens County, Alabama. Bozeman lras sentenced to four

years imprisonment and Wi1,5er to inprisonment for f ive

years. Both h,ere on parole at the time they f iled their
petitions for federal habeas in district court.

App1y.ing the standard of Jackson v. Virqinia, 443 U.S.

307 (1979), the district court held that the evidence

against Bozeman was insufficient to support her conviction

and therefore issued the writ as to her.

The district court concluded that the evidence against

l{ilder was sufficient to sustain her conviction. The court

also heId, however, that both petitionersr juries were



lnstructed on a crime not .charged in their indictment's.

Bccause of such violation of her aixth amendment rights the

distrlct court also lssued the wrlt as to lfilder conditloned

on her retrial within ninetY daYs.

The district court carefully, and lre conclude

correctly, ruled on the various contentions of the parties.

opinion of the district court dated April 13, 1984.
