RE: John Dillard, et al. v. Crenshaw County, Alabama, et al.
Civil Action No. 85-T-1332-N

Dear Judge Thompson:

The above-referenced case is under submission on plaintiffs’
motion for preliminary relief. I write to inquire whether Your
Honor would consider advising the parties either formally or
informally of the decision that Your Honor has reached.

My concern is that with the June 3 election date approaching,
there is an increasing expenditure of candidate and public
resources in the preparation of these elections. It may be that
Your Honor has already reached a decision but because of the
complexity of this case writing the full opinion to accompany
such an order may take some time. Therefore, I suggest that Your
Honor consider issuing either a short order to indicate that the
elections are to be enjoined or not and that a written opinion
would follow. Alternatively, a letter from Your Honor could
inform the parties of the Court's decision though a written
Opinion may be issued some time later.

We have seen similar treatment of issues when we were before
Judge Arnow in the Pensacola voting litigation. I believe such
treatment was helpful, not only to the litigants, but to the
public officials and to the public's understanding of the
election process.

Very respectfully.
