MOTION TO EXTEND TIME 

FOR DETERMINATION OF 

CLASS ACTION   

Plaintiffs respectfully move for an extension of forty-five 

days of the time period within which they are required to move for a 

determination under Local Rule 2.12 whether this matter is to be main- 

tained as a class action. The grounds for this motion are that although 

this litigation was filed and served on defendants on March 26, 1982, the 

defendants have not filed responsive pleadings to date. Additionally, the 

congressional plan of apportionment is currently before The United States 

Department of Justice under the pre-clearance provisions of the Voting 

Rights Act, 42 U.S.C. 197%. and a decision of that Department might moot 

the instant litigation.
