subsequent orders. (Some orders have been reported, some not;
reported. decisions are: 300 F, Supp. 1381; 306 F. Supp. 1281; 306
F. Supp. 1299; 306'F. Supp. 1301; 306 P. Supp. 1306; 311 P.:Bupp
205; 312 F. Supp. 503; and 318 F. Supp. 786.) An appeal was
taken from the order of this Court on February 5,.1970.(311 F,
Supp. 203) leading to an opinion by the Court of Appeals filed
on May 26, 1970 (431 F.24 138). Certiorari was sought and granted
by both plaintiffs and defendants and a decision of the Supreme
Court was rendered on April 20, 1971 (39 L.W. 4437) affirming the
lecisions of this Court. Prior to the decision of the Court of
Appeals, there was litigation in this Court, the Court of Appeals
and the United States Supreme Court (397 U.S. 978) concerning the
defendants' application for a stay. Following the decision by
the Court of Appeals at the time of granting certiorari, the

9. Plaintiffs have heretofore filed motions seeking
to restrain school construction programs until the Board demon-
strates that such activity will promote integration; the Court
has deferred ruling on such motions. The Supreme Court has now

facilities and the abandonment of old facilities have an enormous
