NORMAN C. KATNER, being first duly sworn, deposes and says
as follows:
1. This Deponent is the Assistant Superintendent of West
Bloomfield School District, Oakland County, Michigan.
2. This Affidavit is executed in support of a Petition,
to which this Affidavit is attached, addressed to the United States
Court of Appeals, 6th Circuit, in connection with the litigation
described in the pleadings to which this Affidavit is attached.
3. Deponent shows that he has searched the records of
West Bloomfield School District, and that the allegations made in
this Affidavit are made on his information and belief, based upon
those records, and that he believes the allegations herein made are
true and correct.
4. West Bloomfield School District, as it now exists,
resulted from the consolidation of four (4) predecessor school
districts which may be identified as follows:
a. School District No. 2, known as Scotch
School District. •
b. School District No. 4, known as Hosner
School District.
c. School District No. 6, known as Green
School District.

d. School District No. 5, also known as
West Bloomfield School District and sometimes referred
to as Keego Harbor School District.
Until on or about May 23, 1949, the first three above identified
School Districts were Primary school districts, and the last named
School District was a Graded school district, as those terms were
used in the School Code, more properly identified as Act 319, of the
Public Acts of the State of Michigan of 1927, as amended. The
Deponent shows, on information and belief, that the Primary school
districts were created in recognition of the early needs of the
community as it developed in the wilderness and gradually evolved
into a rural area; and, that the Graded school district was a
classification deemed appropriate by the legislature as population
increased and as the needs of the community changed.
5. Deponent shows that on or about May 23, 1949, pursuant
to a vote of the electorate, the four above named School Districts
were consolidated so as to form School District No. 5, Fractional,
of West Bloomfield Township and Sylvan Lake City, Oakland County,
Michigan, and that the School District thus resulting was classified
as a Rural Agricultural School District.
6. Deponent shows that by virtue of a vote of the
electorate on June 8, 1970, School District No. 5 Fractional of West
Bloomfield Township and Sylvan Lake City, which was created by the
aforementioned consolidation, became a School District of the Third
Class.

7. Deponent shows that the outer boundaries of the present
School District approximate, with only minor adjustments, the outer
boundaries of the original four school districts identified above.
8. Deponent shows that it is his conclusion, based upon
the available records, and his knowledge of the territory encompassec
by the boundaries of the present School District, that the boundaries
of the several original school districts were established and
facilities developed in each in recognition of the needs of the
respective communities, without regard to any classification,
division, or assemblage of persons on any basis related, directly or
indirectly, to race, religion, color or national origin; and, furtheij,
that the consolidation of the school district into the present
entity did not have the effect of excluding or including anyone who
was not previously within the boundaries of one of the four
predecessor school districts, and that the consolidation was effected
without regard to any classification, division, or assemblage of
persons on any basis related, directly or indirectly, tro race, religion,
color, national origin, or to any social or economic status of any
of the persons within said school district.
9. Deponent shows that at no time was West Bloomfield
School District or any portion of it a part of the School District
of the City of Detroit, Michigan. 4
