UNOPPOSED MOTION TO EXTEND TIME FOR ORAL ARGUMENT
TO THE HONORABLE COURT OF APPEALS:
Appellant Harris County District Judge Sharolyn P.
("Judge Wood") moves the Court to extend the time for oral
argument to 45 minutes per "side" for the following reasons:
1. This action is set for argument as the only case to be
heard on June 19, 1990. It is presently allotted 30 minutes per
side for oral argument.
2. Judge Wood views this case as one of major importance
which =-- particularly given the length and thoughtfulness of the
two panel opinions =-- merits additional time. In addition, now
that the en banc panel is in a position to review the issue as to
whether Section 2 of the Voting Rights Act covers judicial
elections, a more thorough and thoughtful discussion of that
iesue by the parties is appropriate.
3. There are complex fact issues that will be revisited
and the legal complexity of the various parties' positions also
justifies additional time.
4. Given the different issues raised by various appel-
lants, it is not accurate to view all appellants as addressing
the same issue or even the same core cf issues. For example, the
Bexar County Judges address issues concerning intervention.
Judge Entz and Judge Wood address constitutional issues not
raised by the Attorney General. And the Attorney General
disputes the right of other counsel to appear on behalf of some
of the appellants.
5s There are presently six appellants before the Court in
this case. Although not all appellants presently wish to use
time for oral argument, four appellants presently desire some
time and the appellants are experiencing some difficulty in
reaching an agreement regarding division of time. The Attorney
General and independent counsel for Secretary of State Bayoud
remain at odds over whether independent counsel shall share in
appellants' time allotment. While the possibility of agreement
would not necessarily be heightened by additional time, this
Court could assure a more orderly and effective presentation if
there were 45 minutes available per side.
6. In view of the factual and legal complexity of this
case, and as well as the number of counsel desiring to be heard,
Judge Wood believes that allowing additicnal time would facili-
tate an orderly presentation of argument, and thus assist the
Court in its consideration of the issues presented in this
appeal.

time for oral argument.
WHEREFORE, Judge Wood requests the Court to permit each side
45 minutes for oral argument.
