LED JN 2 7 1970 OMAS. CLERK UNITED STATES COURT OF APPE Lonopeny c Terenas, BS FOR THE FIFTH CIRCUIT |" E UNITED STATES OF AMERICA, PLAINTIFF (SOUTHERN D | - VERSUS NOS. 28030 and 28042 HINDS COUNTY SCHOOL BOARD, ET AL, DEFENDANTS UNITED STATES OF AMERICA, PLAINTIFF VERSUS NO. 1120 (W) NATCHEZ SPECIAL MUNICIPAL SEPARATE SCHOOL DISTRICT, ET AL, DEFENDANTS AMENDED FINDINGS OF FACT AND RECOMMENDATIONS It having come to the attention of the Court that on page 6 of the Findings of Fact and Recommendations recently issued herein, the reference to the school board's projected attendance is misleading in that it does not make clear that this projection is based on what the attendance could be and not what it promises to be. Accordingly, the Court dcletos two sentences in the language beginning on line 12, "Should this assignment continue, etc.,'” and substitutes in lieu thereof the following two sentences: "The enrollment for the coming term, should current attendance continue as projected by the school board, would increase the disparity to 847 black and 16% white attendance at the North Campus, and 247 black and 767 white at the South Campus, indicating a strong trend toward re- segregation of these schools; however, white attendance, as evidenced by current enrollments, shows a trend of decreasing. In substantiating its conclusion that both schools will continue to become increasingly black, the school board points to five private and parochial schools in the area, serving grades 1-12, each with two more across the river in Louisiana.” ZL SO CERTIFIED this the &{¢ “day of July, 1970. y en A oo () yd UNITED STATES DISTRICT FUDGE | | | |
