In view of the decision of the United States
Supreme Court in City of Mobile, Alabama, et al. v.
Bolden, et al., 48 U.S.L.W. 4436, (April 22, 1980) and
the Court's denial of certiorari in Nevitt v. Sides,
48 U.S.L.W. 3748 {May 20, 1980), this court considers
final determination in the instant cause to be appropriate.
The parties have 20 days from the date of this order
within which to supply the court with additional legal
memoranda, not to exceed 20 pages in length, considering
the effect of the City of Mobile v. Bolden on the instant
cause.
