Dear Mr. St. Vrain:

I represent appellants Robert J. Smith, €t d1., in the
above-mentioned appeal pending in the 8th Circuit. On
Ivlarch 4, 1986, appellants f iled with their brief a Ivlotion
to Vacate Order, to Remand and for Other Immediate Relief.
The lvlotion is based on an undisputed factual development
which occurred after the filing of the Notice of Appeal
and which implicates appellantsr right to vote in elec-
tions scheduled for l"lay of this year, less than two months
from now.

Appellees' Brief and Response to Appellants' Ivlotion for. . .
Immediate Relief have now been filed. In order to expedite
consideration by the Court of the pending appeal, and par-
ticularly the Motj-on for...Immediate Relief, appellants
hereby waive the filing of a Reply Brief.
