Dear Judge Gibbons:
This office is in receipt of your letter of September
11, 1985, in which you set a status conference for^discussion of
further required proceedings and a timetable for final disposition
of the above-styled case.
As the Court file in this case should reflect, the
State of Tennessee was neither a party nor intervenor in this case
prior to 1983. At that time, the case was before the Sixth
Circuit for the second time and the State, through the Office of
Attorney General, moved to intervene under 28 U.S.C. § 2403(c) for
the limited purpose of defending the constitutionality of T.C.A.
§ 40-7-108. That issue was fully disposed of by the United States
Supreme Court in its decision rendered in this case on March 27, 1985
Given the limited and completed involvement of the State
of Tennessee in the appellate proceedings of this case, this office
feels that our continued involvement in any remaining issues between
the original parties to this lawsuit would be unnecessary and inap
propriate. Accordingly, and unless the Court objects, we do not
intend to participate in further proceedings in this case at the
trial level.
