RESPONSE TO MOTION TO AMEND 
  

Private plaintiff~intervenors~appellants herein object to the 

Motion to amend the Order of this Court issued November 7, 1969 so as 

to give final approval to the proposal of Wilkinson County School District 

to operate its schools on a non~-coeducational basis, on the ground that 

such sexual separation coincident to racial integration denies private 

plaintiff-intervenors-appellants and the class they represent their rights 

under the Fourteenth Amendment to the Constitution of the United States. 

Since the entire Court of Appeals has the same issue before it 

in Smith, et al. v. Concordia Parish School Board, which was orally argued 
  

November 18, 1969, we respectfully suggest that the panel hold in abeyance 

any action on the motion of Wilkinson County School Board until the full Court 

has ruled in the Smith case.
