Dear Judge Pittman: 

In regard to plaintiffs' petition for a permanent injunction 
filed on May 7, 1982, I am writing to call to your attention 
the fact that the 1982 Regular Session of the Legislature 
and four Special Sessions have now been completed without 
any attempt being made by the Mobile County Delegation to 
introduce a remedial districting plan for the City of Mobile. 
We would further point out that, as Your Honor acknowledged 
in recent rulings in Brown v. Moore, the passage of the 
Voting Rights Amendments of 1982 and the decision of the 
Supreme Court in Rogers v. Lodge eliminate any likelihood 
whatsoever that the city will prevail on the merits of 
an appeal. 

  

  

Our petition for an injunction states that we are seeking 
remedial elections no later than August 1983. Assuming 
that Your Honor is not inclined to reconsider your announced 
plan of allowing the incumbents to serve until 1985, we must 
ask you to deny our petition for an injunction promptly 
so that our clients can have an opportunity to obtain appellate 
relief in time for August 1983 elections.
