Dear Fred: 

Pursuant to your letter of April 24, 1979, I have 

done the following calculations in order to determine 

the amount of the 15% of the attorneys' fees award due 

Banks & Nichols for Mel Leventhal's work: First, on 

December 4, 1978, Judge Keady determined that Mel should 
be paid $22,102 for prosecuting the principal part of 
the case, exclusive of interest (the court also awarded 

$1,750 for Nabrit and $4,999.44 costs due to LDF only). 

Second, on January 26, 1979, as amended February 5, 1979, 

Judge Keady awarded to Mel $1,490 in fees for the remainder 

of the case ($40 per hour for 37.25 hours) and $600 to Mel 

for additional legal services ($30 per hour for 20 hours) 
for a total of $2,090, again, exclusive of interest (the 

court also awarded $1,010 ($40 per hour for 25.25 hours 

for Lee and $553.50 costs due to LDF only). Therefore, 

the total amount of Mel's attorney's fees is $24,192 (i.e., 

$22,107 plus $2,090) of which Banks and Nichols is due 

$3,628.80. 
  

Banks & Nichols is also entitled to the same 15% share 

of the interest on the $24,192, accruing variously, which 

is being held in an escrow account by the district court. 
The latter sum, umhappily, will not be available, if at all, 

until the end of the State's forthcoming appeal. :
