ARGUMENT

I .  THE EIGHTH CIRCUIT PROPERLY
AFFIRMED THE FINDING OF UNLAWFUL 
DISCRIMINATION AGAINST THE CLASS.

T h e  e n t i r e  b a s i s  o f  t h e  P e t i t i o n e r s

c h a l l e n g e  h e r e i n a p p e a r s  t o be  t h a t

a l t h o u g h  ( 1 ) t h e R e s p o n d e n t s p r e s e n t e d

a l l e g a t  i o n s and t e s t i m o n y c o n c e r n i n g

i n t e n t i o n a l  a c t s  o f  d i s c r i m i n a t i o n  and  (2)  

t h e  d i s t r i c t  c o u r t  made " n u m e r o u s  f i n ­

d i n g s "  o f  p u r p o s e f u l  d i s c r i m i n a t i o n ,  t h e
