Assistant Attorney General 110 Sherman Street Hartford, Connecticut 06105 RE: DRAFT U.S. DEPARTMENT OF EDUCATION STUDY Dear Mr. Whelan: I have received your letter of March 16, 1993, in reply to Kathryn Ellis’ request of March 15, 1993, that you return the above-referenced study. As you will recall, Dr. Armor referred to the study in his testimony and listed it on his resume. At no time did he indicate that the study or its results were confidential. It remains my position that the use of the document for cross-examination purposes was appropriate. The use of the term "draft" does not signify privilege. We are aware that the Department of Education’s claim that the document is privileged has created a dilemma for your office and do not believe the issue warrants further trouble for your office. You will recall that we readily agreed to withdraw the study as an exhibit when you expressed concern. Rather than causing unnecessary litigation over this tangential issue, our office agrees that you should send to the Department of Education the portion of the document which Dr. Armor inadvertently took.
