Dear Mr. Phippes:

Pursuant to our phone conversation today, I am forwarding
copies of Mobile's appellants' and reply briefs and our
appellees’ brief in Bolden.

I look forward to seeing you and Mr. Walbert on Sunday in
ew Orleans. Make sure you get a copy of the Fifth Circuit's

May 31 en banc opinion in Kirksey wv. Board of Supervisors of
Hynds County, Mississippi, in which they confront washington Vv.
Davis in a way that seems to help us. Obviously, the panel we
ill argue before on June 13th will have to follow Kirksey.
