Dear Judge Pittman: 

Please refer to plaintiffs' Motion for Setting of 
Election, copy of which I received this morning. 

We plan to submit to Mr. 
no later than tomorrow, an application for stay and 
recall of mandate. What disposition he will make of 
such application is unknown, but in any event we intend 
to file a petition for writ of certiorari within the 
time allowed, i.e., within 90 days from March 29, 1978, 
the date of the Fifth Circuit's decision.

Under such circumstances, it seems to me that any 
action at this time with respect to plaintiffs' motion 
would be premature. Nevertheless, I am well aware that
