February 22, 1977MEMORANDUM
TO: Jack GreenbergJames M. Nabrit

Charles S. Ralston
FROM: Drew S. Days, III
RE: Garner v. Memphis Police Department

I believe that about 30 days remain to file our brief in
the 6th Circuit in the Garner case, one that raises
issues relating to the use of lethal force against unarmed
fleeing felons and the constitutionality of so-called
"dum-dum" bullets. The hardback and work folders are in
my files. I would suggest that David Kendall might be
interested in trying his hand at writing the brief in this
case, if his schedule permits. In any case, one of you
should contact Walter Bailey in Memphis to discuss arrange
ments for preparing the brief and appendix in this case.

Please feel free to call me for any information
you think I can provide.
