A hearing was held on February 27, 1985 on the motion of defendant to 

compel production of a "will call" expert witness list and to compel 

production of documents. 

PRESENT: Larry Menefee 

Patricia Bowers 

An exclusive list of trial witnesses shall be exchanged between the 

parties on or before April 15, 1985. This list shall include fact and expert 

witnesses. 

The testimony of Robert Weil and Armand Derfner shall be presented at 

trial by way of deposition. 

The testimony of Lani Guinier shall be presented in person at trial. The 

Testimony of Mack Barham shall be given in person before the court. Mr. 

Barham's testimony will be taken on a day other than the trial date, if 

necessary, at a time agreeable with the court, the parties and Mr. Barham. 

On the issue of document production, the reference by letter to each 

request is as listed in defendant's motion. The ruling of the court is as

As to item "AC: Yorox copies of contemporaneous time records shall be 

produced. If time records are kept on a per day basis, records for all cases 

billed that date shall be given. If time records are kept on a per file 

basis, records for that file shall be given. It is the purpose of the court's 

ruling to provide defendant with the raw data from which plaintiff compiled 

their record of time logged for which compensation is sought. Plaintiff may 

xerox this information and bill defendant at 10¢ per copy. 

As to items "b", "c", and "d": GRANTED. Records as to be provided in the 
  

condition in which they presently exist. 

As to item "e": GRANTED, 
  

As to item "f": GRANTED as to all civil rights cases, including voting rights 
  

cases. 

As to item "g": MOOT. Counsel for plaintiff has advised that no such 
  

statements are presently in existence. 

As to item "h": DENIED. Compliance on the document production shall be on or 
  

before March 20, 1985.
