Appeal from the United States District Court for the
Western District of North Carolina, at Charlotte.
James B. McMillan, District Judge.
(Argued January 5, 1972 Decided February 16, 1972.)
Before HAYNSWORTH, Chief Judge, BRYAN, WINTER, BUTZNER,
RUSSELL and FIELD, Circuit Judges, in banc. *
William J. Waggoner (Waggoner, Hasty and Kratt, on brief)
for Appellants, and J. LeVonne Chambers (Adam Stein,
Chambers, Stein, Ferguson, and Lanning, and Conrad O.
Pearson, Jack Greenberg, James M. Nabrit, III, and
Norman Chachkin, on brief) for Appellees.
x Judge Craven was disqualified from participating
in these proceedings.
PER CURIAM:
The district court required the modification
of an amended "feeder plan" for pupil assignment proposed
by the school board as a revision to the court order ap-
proved in Swann v. Charlotte-Mecklenburg Board of Educa-
tion, U.S, 11971), and, as modified, author-
ized it to be put into effect.” We do not think that the
district court exceeded its equity powers or abused its
discretion in approving the plan or in requiring the
modifications thereto.
