Chief Deputy Clerk
United States Supreme Court

Re: Tennessee v. Cleamtee Garner
No. 83-1035Memphis Police Department v. Cleamtee Garner
No. 83-1070

Dear Mr. Lorson:
The motion to affirm or dismiss and the brief

in opposition in the above noted actions, respectively,
are currently due on February i6, 1984. Because
of the exigencies of Evans v. Mississippi, which
was filed in the Court today, it appears that I
may not be able to complete these submissions by
the 16th. Accordingly, I request an additional
extension of ten (10) days.

Thank you for your attention to this matter.
Yours sincerely.

Steven L. Winter
