MEMORANDUM

TO: Cromartie Trial Participants

FROM: Tiare B. Smiley

Special Deputy Attorney General

DATE: November 17, 1999

SUBJECT: Cromartie Trial

We have received word from the Federal court that the Cromartie trial will proceed on

Monday, November 29, 1999 and run for four days. We hope to talk to plaintiffs about the order in

which witnesses will be called, but assume that the defendants will start calling their witnesses on
Tuesday. We will need to make arrangements for witness preparation between now and November
29th, and will need to know Thanksgiving holiday schedules. Obviously, there will be some
preparation that will have to take place during the holiday. You will be provided more details as soon
as they are available,
