ORDER APPROVING CHANGES IN PRECINCTS, ELECTION DISTRICTS AND POLLING PLACES IN LEE COUNTY, ALABAMA ON INTERIM BASIS On the 30% day of April, 1986, the Lee County, Alabama Plaintiffs and Defendants in this suit file z Joint ¥otion seeking Court approval of changes in precincts, election districts and polling places in Lee County, Alabama as shown on Exhibit "A" filed therewith. The Motion alleged that such changes were made sO that the election districts used in County and State elections would be the same or very similar to those to be used in the City of Opelika, Alabama which have been pre-cleared by the Justice Department pursuant to 42. .0.8.C.8. 1973c. Under the provision of State law, Section 17-5-3, 1875 Code of Alabama, the County Commission has the authority to change the boundaries of election precincts and districts but is limited to making such changes more than three months prior to any election ’ Section 17-5-8, 1975 Code of Alsbzme. The Court has considered the proposed changes in precinct and election district lines and in polling places set out in the lotion and Exhibits thereto and finds that such changes will be helpful to the voters of Beat 2 in Lee County, Alabama in avoiding ® | 4 confusion in future elections and that such changes will not violate the rights of any of the voters of Lee County or be of any detriment to them in thew voting. THEREFORE, it is ORDERED, ADJUDGED and DECREED as follows: 1. This Court has jurisdiction of the parties and the subject of this Motion. 2. Due to the short time remaining before the primary election to be held on June 3, 1986, the Court orders the Defendants to sndtontnt the proposed changes as described in this Motion for the primary election to be held on June 3, 1986 and any other elections to be held during the year 1986. 3. The Court directs that Lee County, Alabama inform the Court immediately upon determination by the Justice Department and if the Justice Department has any objection to the proposed changes, Lee County shall forthwith make any changes required by the Justice Department for approval.
