of the Honorable Herbert A. Posner herein dated January 31, 1997 and entered in the office of

the Clerk of Queens County on or about February 5, 1997, which denied defendants’ cross-

motion for summary judgment and this appeal is taken from each and every part of said order

and judgment (one paper) as well as from the whole thereof.
