As you can see, Robinson Everett is apparently trying to have his summary judgment motion and 

brief considered as his brief on the preliminary injunction monion. | am not yet sure how the 

State intends to respond to this. 

1 talked to Tiarg Smiley and passed along your comments about paragraph 5 in the Cooper and 

McMahan affidavits. In addition, | explained your reasoning for considering Richard Engstrom 

10 be the best expert to give us a short affidavit refuting Lee Mortimer’s conclusions on the First 

district in his affidavit. As soon as you get me Engstrom’s telephone number in Australia, I'll 

call her back and find out what they think of Robinson Everen’s latest pleading. Thanks for all 

your help.
