RE: FURMAN v. GEORGIA
No. 50359, O.T, 1970
Dear Mrs. DuBois:
This will inform you that the Court yesterday
took the following action in the above case:
"The motion for leave to proceed in forma
pauperis is granted. The petition for a writ of
certiorari is granted limited to the following
question:
'Does the imposition and carrying out of the
death penalty in this case constitute cruel and
unusual punishment in violation of the Eighth and
Fourteenth Amendments?'"
Enclosed is a memorandum describing the time
requirements and procedures under the Rules.
Since the petitioner is proceeding in forma pauperis,
we will meet the costs of printing the appendix and the brief, but
it will be your obligation to submit the copy to us in proper
form to send to the printers. After you have reached an agreement
with opposing counsel as to the contents of the appendix, you
should mark the record for the printers, prepare an index and
forward to this office to be printed. You must prepare copy first
of the appendix and later of the brief.
