Hunter, Jr. Hunter, Johnston, Elam & Benjamin, PLLC 822 North Elm Street, Suite 200 Greensboro, NC 27401 Re: Amicus Curiae Motion and Order Dear Bob: Based on our conversation yesterday, and earlier conversations you had with Eddie Speas. we wanted to confirm our understanding of the intentions of the Republican congresspersons with regard to appearing as amicus curiae in the Cromartie litigation. It is our understanding that your clients intend to support the 1997 Congressional Redistricting Plan and its use in the impending election. or at worst to fall back to the 1998 plan as the other known quantity. Furthermore, the appearance as amicus is intended to be limited to the filing of a brief. It was based on this understanding that the defendants consented to the motion to appear as amicus curiae. We certainly understand the congresspersons’ interest in this case and appreciate their participation. With the trial so close and the need to move forward expeditiously, we hope you can understand our concern that your amicus role will be limited to filing a brief, as indicated in your proposed order.
