Dear Mr, Justice: 

On October 5, 1978, Appellees in the above-referenced matter 
filed in this Court and in the United States Court of Appeals for 
the Fifth Circuit a motion to vacate the October 2 Order of the 
District Court staying elections in the City of Mobile pending 
this Court's dispostion of the City's appeal (probable jurisdic- 
tion noted October 2, 1978). 

We are informed that this day the Court of Appeals (per Wis- 
dom and Tjoflat, J. J.) has issued an order denying Appellee's 
motion to vacate this stay of elections.
