Re: Cromartie Trial Date

Dear Sirs:

It has just come to my attention that the continuance of the trial date in the Cromartie case

from November 1, 1999 to an unspecified future date could result in a potential conflict. Senator Roy

Cooper, who is Chairman of the Senate Redistricting Committee and one of defendants’ main trial

witnesses, is scheduled to be in Israel from November 27 through December 3, 1999, with the North

Carolina Israeli Partnership. The trip involves economic development and technology issues and the

Senator is making the trip in his legislative capacity.

Although defendants do not wish to cause any undue delay in setting this case for trial, we

would appreciate your taking Senator Cooper’s prior commitment into consideration.

Very truly yours, 3
