Dear Judge Hammer:
The plaintiffs are writing to request oral argument in this case
during the month of April. As you know, we completed the trial in
early 1993 and post-trial brief were submitted by August. Supplemental
briefs were submitted to you in January of this year after certain
issues were raised relating to the new legislation on diversity.
our clients as well as many members of the Hartford community
have been anxiously awaiting the date for the oral argument so the case
will be completed and ready for a decision.
We have contacted Assistant Attorney General John Whelan and both
parties are available for a status conference this week. Attorney
Whelan is not available tomorrow afternoon or Wednesday afternoon, but
the rest of the week is open for both sides. On the assumption that
Your Honor would not want the oral argument to be held before the end
of April, I have conferred with Attorney Whelan and both sides would be
available for oral argument at any time during that week except for
Monday, April 25.
I also will have personal problems if the argument is not held
this month. I have a number of appellate arguments which may be
scheduled for early May. In addition, my family and I have a long
scheduled trip to Prague, and we are leaving on May 15. Finally, my
partner Susan Cormier is almost nine months pregnant. She will shortly
be taking a maternity leave, during which time I will be handling many
of her files.
