MARVIN E. FRANKEL, being duly sworn, deposes and says:
1. I am a member of the State Bar of New York. I am a
member of the firm of Kramer, Levin, Nessen, Kamin & Frankel. I
have been a practicina lawyer and U.S. District Judge (1965-1978)
for over 35 years, specializing in litigation, and am familiar
with the criteria relative to the fixing of attorneys' fees in
New York City. This affidavit is made by me as an expert witness
on the issue of the reasonableness of the amount of the fee award
recuested by plaintiffs in this action.
2. I have been informed that C. Lani Guinier was graduated
from Yale University Law School over ten years ago and that she
has been engaged in civil litigation, following the completion of
a two-year clerkship for a distinguished federal judge, princi-
pally in the field of discrimination in voting rights. For a
person of Ms. Guinier's experience and background, it is my
opinion that the requested $160.00 per hour is a reasonable
hourly charge measured by the standards of the New York City
metropolitan area.
S. It is the common practice in New York to charge clients
separately for disbursements in addition to hourly charges for
professional services.
