STIPULATION
Presbyterian Day School of Cleveland, Mississippi, and
Plaintiffs to this Action, stipulate as follows:
l. At the end of the current school year - May, 1975-
the Presbyterian Day School of Cleveland will return to the
Mississippi Textbook Purchasing Board, or its designated agent(s),
all state owned textbooks presently held by the school or en-
trusted to the students enrolled therein as determined by the
defendants' current inventory list.
2. In view of the foregoing decision to surrender textbooks,
the Presbyterian Day School has not determined at this time
whether or not it will for the 1975-76 school year engage in an:
active and vigorous recruitment program to secure
black students or teachers, including student drants-
in-aid, . . . continued meaningful public advertise~-
ment stressing the school's open admissions policy . . .
[or communicate] to black groups and leaders within
. the community . . . the school's nondiscriminatory
practice . . .
Norwood v. Harrison, 382 F.Supp. 921, 926 (N.D. Miss. 1974)
No decision has been made by the school on whether it will
engage in the above stated practices for school years subsequent to
1975-76. However, during the 1974-75 school year, the only action
taken by the school, in response to the above cited Norwood opinion,
was the submission to the local newspaper of Cleveland, Mississippi
a Notice of Non-Discriminatory Admissions Policy, which notice was
never printed; in the opinion of the school, the Court's July, 1974
Norwood opinion-order came too late for any effective recruitment
of teachers or pupils for the 1974-75 school year.

3. The Presbyterian Dav School of Cleveland agrees that
henceforth it will not be eligible for state owned textbooks
except upon the approval of the United States District Court
for the Northern District of Mississippi.
4. In view of the foregoing stipulation the parties
jointly suggest that there is no present need for an evi-
dentiary hearing on the question of the Presbyterian Day
School's eligibility for state textbooks.

ORDER
Upon the Stipulation entered into by the Presbyterian
Day School of Cleveland and plaintiffs to this action, it 1is
hereby ORDERED:
l. Presbyterian Day School shall return to the Mississippi
Textbook Purchasing Board, or its designated agent(s), all
textbooks presently held by the school or entrusted to the
students enrolled therein as determined by defendants' current
I! inventory list.
2. Plaintiffs' objections to textbook aid for the
Presbyterian Day School of Cleveland are hereby dismissed,
without prejudice in the event the said school again applies
to the Mississippi State Textbook Board for textbook assistance.
3. Any future application for textbook assistance made
by the subject school to the Mississippi Textbook Board shall
not result in the distribution of textbooks to the school without
prior .approval of the Court. Norwood v. Harrison, 382 F.Supp.
921, 935 (N.D. Miss, 1974).
