The State of Alabama; Don Siegelman, Attorney General for

the State of Alabama, respectfully seek leave of this Court to 

file the attached brief, which is filed conditionally pursuant 

to Fed. R. Civ. P. 29, to assist the Court in resolving the 

question of whether the vote dilution theory of Section 2(b) of 

the Voting Rights Act applies to judicial elections. 

The movants have been parties since 1988 in voting rights 

litigation involving substantially the same issues presently 

before this Court. See Southern Christian Leadership 
  

Conference v. Siegelman, 714 F.Supp. 511 (M.D. Ala. 1989). The 
  

resolution of the Siegelman case will be directly affected by 
  

the decision reached in the instant case by the Fifth Circuit 

Court sitting en banc. 

Movants respectfully request that the attached 

conditionally filed brief amici curiae be filed in this case. 

Alternatively, Alabama files the accompanying brief without 

leave or consent pursuant to Fed. R. Civ. P. 29.

move for leave to file the attached brief amici curiae in the 

present case. This Court is rehearing the present case en banc, 

and one of the issues before the Court is whether Section 2 of 

the Voting Rights Act, 42 U.S.C. Section 1973, permits challenges 

to at-large elections for state court trial judges. Clark raises 
  

the same issue with respect to state court trial judges in 

Louisiana, and this Court’s disposition will affect the 

litigation in Clark. For that reason, the plaintiffs in Clark 

 



  

have a direct interest in the present case. 

In Clark, the United States District Court for the Middle 

District of Louisiana found violations of Section 2 with respect 

to several trial and appellate court multimember election 

districts in Louisiana. Clark v. Edwards, 725 F.Supp. 285 (M.D. 

La. 1988). (The case originally was denominated Clark v. 
  

Edwards, but the current Governor since has been substituted as a 

defendant, and it is now called Clark v. Roemer). The question 
  

of remedy is now pending before the district court. 

The plaintiffs in Clark have spent a great deal of time 

studying the issues before the Court in the present case. In 

addition, they are able to inform this Court about developments 

in the Clark litigation that could help illustrate the impact of 
  

the various potential rulings this Court may be considering in 

the present case. For these reasons, the (Clark plaintiffs 

believe their brief will be of benefit to the Court, and 

respectfully request leave to file the brief.
