Dear Bob: 

I have spoken with my co-counsel relative to your request that the parties 
jointly submit Act 2 of the 1983 First Extraordinary Session as a remedy in 
this case. 

Because we represent a statewide class we don't feel we should jointly submit 
the plan with you and perhaps foreclose a classmember's attempts to intervene 
and challenge the plan. We know of no intentions by anyone to do so: our 
position is one taken out of an abundance of caution. 

We will have no opposition to adoption of the plan by the Court, however. 
The difference is a subtle one, but one we feel is important in discharge 
of our ethical obligations to absent classmenbers. 

I'm sure you appreciate our position, but if there is any question, please 
do not hesitate to get in touch with me.
