Secretary Califano will not assert the executive privilege. 

Counsel for Secretary Califano requests that this Court rule on 

the pending motions on the basis of the briefs and proposed 

orders already filed by balancing the government's need for 

nondisclosure of governmental advisory and deliberative communi- 

cations with the litigants need to know, after this Court has 

viewed the documents in camera. Carl Zelss Stiftung v. E. B. 
    

Carl Zeiss, 40 F.R.D. 318 (D.D.C. 1966) aff'd per curiam, 384   

F.2d 1979 (D.C.Cir. 1966) cert, denied, 398 U.8. 952. Defendant   

Califano again points out that Item Number 6, the Draft "Final 

Report" was never adopted by the Department and therefore does 

not reflect the Secretary's policy or position on the subject 

matter or conclusion contained in the document.
