MOTION FOR EXTENSION OF TIME  

Pursuant to Rule 26(h) of the Federal Rules of 

Appellate Procedures, undersigned counsel moves for an 

enlargement of time in order to file a brief for Appellee for 

the following reasons: 

1. 

The current budgetary crisis in Louisiana has caused a 

reduction in force by two-thirds in the Department of Justice. 

As a result, the demands on the existing staff are such that 

priorities are constantly being shifted to meet emergency 

demands such as Death Row Writs, Injunction Proceedings, etc. 

2. 

Further, we have been informed that the United States 

District Court for the Southern District of Ohio has rendered 

an opinion in Mallory v. Eyrich, U.S.D.C. #C-1-86-1056

(S.D. Ohio, Western Division, 1987) which has a bearing on the 

Appellee's brief in that, the District Judge held that Section 

2 of the Voting Rights Act does not apply to judges. However, 

we understand that his reasoning differs from the opinion 

rendered by Judge Schwartz in the captioned case though we have 

not had an opportunity to review the Reasons for Judgment. 

Therefore, Appellees, for good cause shown, move this 

court for an enlargement of time from September 8, 1987 when 

the brief is currently due.
