The merger, begun in July, of Tennessee State University, the state's 

ger preeminent black public higher educational ban percca’ institution with 

the University of Tennessee at NashXi1le as order by the U. R- District 

Court in Nafidville will go ahead under the administrative control of 

the black school, as requested se NAACP Legal Defense Fund and the 

U. S. Department of Justice. ea iia Supreme Court decision # not to 

grant review to the University of Tennessee leaves undist€ubed the decision 

of the U. S. Court of apefais m for the Sixth Circuit upholding the 

merger. The decision came in Geier v. Blanton, a case in which LDF

represented blacKstudents, potential students, faculty and staff. It 

represents a major advance toward LDF's twin goals of eliminating the 

continuing dual systems of public higher education in many Reutwey este: 

while at the same time insuring eng the traditionally black colleges are 

mt closed or downgraded in an effort to integrate state systems.
