Dear Mr. Still: 

I have your recent letter of September 11, 1986, concerning 
the special primary election to be held for new districts 5 and 
6 on November 4, runoff on November 25, and general election on 
December 16, 1986. 

With regard to your inquiries I submit the following: 

l. In an effort to let voters and potential candidates in 
Districts 5 and 6 know of the special primaries, election, and 
qualification deadlines, the following has been done: 

(a) The Gadsden Times (local newspaper), 
and local radio stations, as public service announce- 
ments, have announced numerous times about the 
settlement of the case in the United States District 
Court for the Middle District of Alabama; have advised 
of the Tentative Order signed by the Judge approving 
a new six district redistricting plan; have notified persons 
that party primary elections for District Commissioners 
for Districts 5 and 6 would be held on November 4, 1986, 
primary runoff elections on November 25, 1986, and the 
general election for new District Commissioners for 
districts 5 and 6 on December 16, 1986; and have advised 
that qualifying dates for candidates were from September 
16 through September 26, 1986. 

(b) The Etowah County Commission has forwarded 
the enclosed Notice of Special Elections, copy of 
of the Tentative Order of the Court, a copy of the 
Notice to Class, and copy of the legal descriptions of 
Districts 5 and 6 to the following racial minority 
group members, interested persons active in civil 
rights, the plaintiffs in the Federal Court action, 
and others as listed below:

(c) The Etowah County Commission has purchased 
commercial radio time on radio stations WAAX, WGAD, and 
WMGJ (minority operated) causing notices to be given of the 
dates and times for the special elections for District 5 and 
6 of the Etowah County Commission, and the qualifying dates 
for candidates who wish to run for the positions. 

(d) The Etowah County Commission has purchased 
commerical advertisement space in the Gadsden Times, 
the only newspaper published in Etowah County, to 
run notice of the special elections and the manner and 
time which candidates may qualify for the positions.

(e) The Etowah County Commission has run legal 
ads in the Gadsden Times styled "Notice to Class" advising 
the general public of the new districts and the 
redistricting plan that has been tentatively approved by the 
Federal Court. 

(f) Announcements have been made at commission 
meetings concerning the new districts, the special 
elections for district commissioners 5 and 6, and the 
manner and time in which persons may qualify for those 
positions. 

2. The County Committees of the Democratic Party and the 
Republican Party have each set qualifying dates for the special 
primary elections. They are from September 16 through September 
26, 1986. These dates have been published at the same time the 
general notice of special elections has been given. 

3. Voters in Districts 5 and 6 are now being re-identified 
through the personnel of the Probate Judge's Office of Etowah 
County. When all are identified, new voter lists for District 5 
and 6 will be published in the Gadsden Times. 

Since the first primary election will coincide with the 
November 4 General Election, special district poll lists for 
Districts 5 and 6 and special voting machines will be set up at 
the regular polling places to accommodate the primary election 
votes in Districts 5 and 6. After each person voting in the 
general election at boxes in Districts 5 and 6 completes his or 
her voting in the general election, he or she will then be 
directed to the poll list of the voters in the box that live in 
Districts 5 or 6. If his or her name appears on the commission 
district voting list, he or she will then vote for his or her 
candidate in the primary election on the voting machines 
reserved solely for primary voting. No one voting in the 
general election at a polling place who does not live in 
commission district 5 or 6 will be allowed to vote on the 
special voting machines for this primary election. No machines 
for primary voting will be allowed at voting places which do not 
contain voters living in Districts 5 or 6.
