ON APPEAL from the United States District Court for the Eastern District of North 

Carolina. 

THESE CAUSES having been submitted on the transcript of the Ford and were 

argued by counsel. 

ON CONSIDERATION WHEREOF, it is ordered and adjudged by this Court that the 

judgment of the above court is reversed with costs, and the cases are remanded to the 

United States District Court for the Eastern District of North Carolina for further proceedings 

in conformity with the opinion of this Court. 

IT IS FURTHER ORDERED that the appellants James B. Hunt, Jr., Governor of North 

Carolina, et al., and Alfred Smallwood, et al., recover from Martin Cromartie, et al., Four 

Thousand Eight Hundred Fourteen Dollars ($4,814.00) for costs herein expended.
