I enclose a copy of petitioner,s Motion for
Summary Judgment and supporting t{emorandum
of Law. As this motion r,ras being prepared
f9r f ilingr w€ received a copy oi lfre-neply
of Respondents to Petitioner's Response to
this Court's Order of December Z, 1983. The
Respondents presumably will argue and raise the
same contentions in response to petitioner's
Motion for Summary Judgment.
W€, therefore, await notification of the Court,s
preference whether we should anshrer the Reply of
Respondents or respond to the Respondent,s con-
tentions when they answer the Motion for Summary
Judgment.
In additionr w€ respectfully request that the
Court schedule a hearing on petitioner's Motion
for Summary Judgment after both parties have had
an opportunity to file Reply Briefs.
