Re: Garner v. Memphis Police Deot.,
No. 81-5605 -------------- -

Dear Sir:

This is to confirm my communication with your
office on February 22, 1982, regarding the Brief
for Appellant in the above noted action. Pursuant
to the procedure for cases involving the use of a
deferred appendix, we timely filed ten copies of
the brief, with citations to the Appendix, by
mail on February 16, 1982, which were received
and filed by your office on February 18. Due to
an oversight, the copies filed are missing 12
pages, pp. 15-25, which were included in the
original brief filed on December 4, 1981. I was
advised that I may file replacement copies of the completed brief.

Enclosed are ten replacement copies of the
Brief for Appellant. These copies are complete
and are the same as the brief initially filed and
served on December 4, 1981. Pursuant to FRAP
30(c), no changes have been made other than the
insertion of citations to the Joint Appendix and
the correction of typographical errors.

Thank you for your indulgence in this matter.
Sincerely,

Steven L. Winter
