I agree with you on the utility
Of meeting with Leo Pfeffer. If you
will prepare a file of relevant materials
for me in Norwood v. Harrison I will send
them on to him and ask him to read them
in advance of the conference.
Why is Mel concerned about juris-
diction in the Supreme Court? Without
reading the pleadings and so forth,
it appears to me to be a three-judge
court case. If he is seeking to enjoin
the enforcement of a state statute of
statewide applicability by proceeding
against a state officer, it is difficult
to think of how the case could have been
framed to avoid doing that.
Perhaps we should talk about
jurisdiction and get Nabrit in on it
