It is ORDERED that the motion of plaintiff-appellees and
Dallas-plaintiff-intervenor-appellees that this Court enjoin the
forthcoming judicial elections in Texas is DENIED as, among other
things, premature. As the district court wisely and correctly
noted, it is greatly preferable that the elected Texas
authorities put their own house in order, if that be needed, then
that this be attempted by unelected judges from the federal
government. With the Governors call of a Special Legislature
Session, that process has now commenced. As of today, the State
could have done no more than it has done, and it is now our part
to wait upon events: the appeal of the district court’s orders on
their merits and the action of the Texas Legislature.
