James M, Nabrit III will seek broader faculty desegregation in 

ithe 4th U.S, Circuit Court of Appeats in Richmond Monday (MAY 30). 
Mr, Nabrit will argue an appeal of a U.S, District Court 

decision that refused to Malt faculty segregation in Durham, N.C., 
public schools. The Legal Defense Fund also contends that the 
"free choice" desegredat in approved by the District Court 
last January does,foteccomplish Gnough pupil desegregation. 

The 5th Circuit Court of Appeals, which covers most of the 
Deep South, has held that faculty desegregation must begin in the 
coming school year. The 4th Circuit nich, includes Virginia, 
North and South Cafolina, Maryland West’ Virginia, has yet to 
rule specifically onthe faculty issue. 

Legal. Defense Fund and U,S. Justice Department lawyers argued 
further for faculty desegregation in a series of cases before the 
Sth Circuit May 24 and 25. Guidelines issued by the U.S, Office of 
Education also call for faculty desegregation. 

Monday's appeal will be the fourth in the Durham casey which 
dates back to 1960.
