It appearing to the Court from sintempiit of counsel for the 

defendants that the Board of Education holds premises formerly occupied 

by the Glidden Paint Company on the southerly side of Independence 

Boulevard near Second Ward High School under a lease which expires, 

including options, in November, 1970. It further appearing to the Court 

that the premises are not being utilized in connection with the educational 

program conducted by the Board of Education during the current year and       there is no apparent future use for the premises, the Board of Education

does not own or control any other property contiguous to the leased 

premises and the Board of Education is not in position to require an 

extension of the lease. | 

IT IS THEREFORE ORDERED that the order of this Court 

dated August 15, 1969, be and the same is hereby modified to allow the 

Board of Education to surrender the premises formerly occupied by the 

Glidden Paint Company.
